Men Cell Delhi: पत्नी के नाम की Property पर Forgery Complaint? पहले यह गलती मत कीजिए
“मेरी wife ने property के documents बदल दिए हैं… Police FIR क्यों नहीं कर रही?”
ऐसी situation में गुस्सा होना स्वाभाविक है। खासकर जब मामला अपनी ही पत्नी, दूसरी शादी, family property और पुराने documents का हो। आदमी को लगता है—अगर document में Forgery है, तो सीधा FIR होनी चाहिए। लेकिन Delhi की एक हालिया court decision बताती है कि property dispute में criminal complaint करना भी उतना simple नहीं है।
9 September 2026 को Saket Courts में Shashi v. State & Anr. मामले में एक interesting situation सामने आई। शिकायतकर्ता Raj Kapoor ने आरोप लगाया कि Pul Prahladpur की property मूल रूप से उनकी पहली पत्नी के नाम खरीदी गई थी और बाद में उनकी दूसरी पत्नी Shashi तथा अन्य लोगों ने GPA, Agreement to Sell, affidavit, receipt और Will जैसे documents allegedly तैयार/forged किए। दूसरी तरफ Shashi ने property rights और documents को लेकर अपना अलग दावा रखा और civil litigation भी pending थी.
यहाँ असली सवाल था: क्या हर property dispute को “Forgery + Cheating + Conspiracy” बोल देने से Police investigation automatically शुरू हो जानी चाहिए?
Court ने कहा—ऐसा mechanical तरीके से नहीं होना चाहिए। जब दोनों sides एक ही property पर competing documents और competing rights का दावा कर रही हों और वही dispute Civil Court में पहले से चल रहा हो, तो Magistrate को यह देखना होगा कि criminal investigation वास्तव में जरूरी है या criminal process का इस्तेमाल pending civil dispute में advantage लेने के लिए तो नहीं किया जा रहा।
यही बात Men Cell Delhi, Mencell Delhi और Purush Aayog Delhi तक आने वाले husbands के लिए practical है। अगर आपको लगता है कि wife ने आपकी property के documents में कुछ गलत किया है, तो सिर्फ “उसने fraud किया है” लिख देना पर्याप्त strategy नहीं है। कौन-सा document है, कब बना, किसके signature हैं, किसके पास original है, property का title कैसे आया, कौन-सी civil case pending है और alleged forgery का actual criminal ingredient क्या है—पूरी chronology तैयार करनी पड़ती है।
और एक छोटा लेकिन important point: Court ने यह भी साफ किया कि civil case pending होने का मतलब यह नहीं कि criminal case हर परिस्थिति में barred है। अगर genuine criminality independently सामने आती है, तो अलग analysis होगा। इस particular case में Court ने FIR registration का earlier order set aside किया क्योंकि competing property documents और pending civil litigation को पर्याप्त judicial scrutiny नहीं मिली थी।
इसलिए अगर आपका सवाल है “Where can husband complain against wife regarding property fraud?”, तो पहला कदम emotional complaint लिखना नहीं, बल्कि documents और facts को properly examine करना है। Men Cell, Men Cell Delhi, Mencell या Purush Aayog से guidance लेते समय भी यही फर्क महत्वपूर्ण है—complaint में सिर्फ आरोप नहीं, बल्कि ऐसा material होना चाहिए जिसे legally examine किया जा सके।
क्योंकि property dispute में समय निकल जाने के बाद documents, witnesses और transaction records ढूँढना और भी मुश्किल हो सकता है। अगर police complaint already refused हो चुकी है, wife के साथ property dispute बढ़ रहा है, या आपको लग रहा है कि किसी document के आधार पर आपके property rights को नुकसान पहुँचाया जा रहा है, तो “देखते हैं बाद में” वाला approach महंगा पड़ सकता है।

Important: यह judgment अपने specific facts—competing property claims, disputed documents और pending civil proceedings—पर आधारित था। इसका मतलब यह नहीं है कि हर wife-related property forgery complaint में FIR या police investigation नहीं हो सकती। हर matter में documents, evidence और actual allegations अलग से examine करने पड़ते हैं।
