कई साल पुराना matrimonial dispute है.
एक Court पहले ही marriage के बारे में फैसला दे चुकी है.
फिर बाद में maintenance proceedings शुरू होती हैं.
और husband फिर वही पुराना सवाल उठाता है — “वह मेरी legally wedded wife ही नहीं है.”
लेकिन क्या एक बार Court से final हो चुका issue बार-बार reopen किया जा सकता है?
A recent Delhi High Court judgment dated 31 August 2026 gives an important answer.
In A v. M, CRL.REV.P. 1019/2018, the husband had earlier initiated proceedings challenging the marital relationship. Although he initially obtained a favourable decree, the wife's appeal succeeded in 2006, and the subsequent challenge was also dismissed.
Years later, when the wife sought maintenance under Section 125 CrPC, the husband again attempted to dispute the marriage.
The Delhi High Court refused to reopen the issue.
The Court held that the earlier finding had become final and conclusive and the husband could not seek to escape its consequences by raising the same decided issue again in a fresh proceeding.
यानी matrimonial litigation में सिर्फ नया case number आने से पुराना फैसला automatically खत्म नहीं हो जाता.
This is a very important practical lesson for husbands.
अगर किसी earlier proceeding में marriage, divorce, jurisdiction, custody, settlement या कोई दूसरा foundational issue finally decide हो चुका है, तो अगली proceeding में वही point फिर से उठाने से पहले उसकी complete judicial history देखना जरूरी है.
पुरानी petition.
Appeal.
High Court order.
Dismissal order.
Finality.
सब कुछ.
NRI husband के लिए यह और भी important हो सकता है, क्योंकि years later India में शुरू हुई maintenance या matrimonial proceeding के सामने पुराने Indian court orders की पूरी history तुरंत available न हो तो unnecessary confusion पैदा हो सकता है.

क्या इस issue पर पहले कोई Court order आ चुका है?
क्योंकि कभी-कभी case की सबसे important document नई complaint नहीं, बल्कि 15 साल पुराना judgment होता है.
और अगर कोई husband सोच रहा है कि “पुराना मामला था, अब फिर से वही point उठा देंगे”, तो ऐसा कदम लेने से पहले legal record की proper review बहुत जरूरी है.
