Men Cell Delhi: Wife ने RTI से Husband की ITR मांगी तो क्या होगा?
“मेरी wife मेरी Income Tax details क्यों मांग रही है? क्या वह RTI लगाकर मेरी पूरी ITR निकलवा सकती है?”
बहुत से husbands को लगता है कि matrimonial dispute शुरू होते ही उनकी salary, tax returns और financial records शायद खुले documents बन जाते हैं। लेकिन Delhi High Court के एक important 2026 decision ने इस issue पर एक interesting privacy question examine किया।
मामला Kapil Agarwal v. CPIO, Income Tax Officer का था। एक estranged wife ने RTI के जरिए अपने husband की net taxable income की details मांगी थीं, जिसमें Financial Year 2007–08 से आगे की information शामिल थी। Central Information Commission ने disclosure का direction दिया था, जिसे husband ने Delhi High Court में challenge किया।
Delhi High Court ने CIC का order set aside कर दिया। Court ने माना कि income-tax returns और उनसे जुड़ी personal financial information personal information के दायरे में आती है और Section 8(1)(j) RTI Act के तहत privacy protection लागू हो सकती है। Court को matrimonial dispute में ऐसी RTI disclosure के लिए required “larger public interest” नहीं मिला।
लेकिन यहाँ एक बहुत important twist है।
इसका मतलब यह नहीं कि husband अपनी actual income छिपा सकता है।
Court ने यह distinction साफ रखा कि अगर maintenance या किसी matrimonial proceeding में financial disclosure legally required है, तो wife appropriate court proceedings में disclosure मांग सकती है। Court ने Rajnesh v. Neha के framework का भी reference दिया, जिसके तहत assets और liabilities के affidavits के जरिए financial position सामने लाई जा सकती है।
यही point Men Cell Delhi, Mencell Delhi और Purush Aayog Delhi से guidance लेने वाले husbands के लिए काफी useful है।
अगर wife कह रही है, “मुझे उसकी ITR चाहिए,” तो दो अलग सवाल हैं—क्या वह RTI से Income Tax Department से आपकी personal information मांग सकती है? और दूसरा, क्या matrimonial court के सामने आपकी actual income disclose करनी पड़ सकती है? दोनों को एक ही चीज समझना गलती हो सकती है।
और honestly, आजकल financial privacy भी कोई छोटी चीज नहीं है। Salary, ITR, investments, tax records और business income की details किसी के हाथ में चली जाएँ तो मामला सिर्फ maintenance तक सीमित नहीं रह सकता। इसलिए Men Cell, Men Cell Delhi, Mencell या Purush Aayog Delhi तक आने वाले husbands को अपनी financial documents की handling भी seriously देखनी चाहिए।
अगर आपका सवाल है “Can wife get husband’s ITR through RTI?”, तो इस Delhi High Court decision के facts में answer था—RTI route से ऐसी personal financial information का disclosure justified नहीं था। लेकिन matrimonial court के सामने legally required financial disclosure एक अलग matter है।

इसलिए panic में documents छिपाने या दूसरी तरफ से financial information रोकने के लिए गलत तरीका अपनाने की जरूरत नहीं है। पहले यह समझिए कि information किस legal route से मांगी जा रही है, किस proceeding में मांगी जा रही है और उस proceeding में आपकी disclosure obligations क्या हैं।
अगर आपको notice मिला है, wife ने RTI application या financial disclosure की मांग की है, या आपको डर है कि आपकी personal tax information गलत तरीके से circulate हो सकती है, तो “देखेंगे बाद में” वाला approach risky हो सकता है। RTI record, court notice, maintenance proceeding और आपके financial documents को समय रहते properly examine कराना बेहतर है।

अगर आपकी wife आपकी ITR, salary records या tax information मांग रही है और आपको समझ नहीं आ रहा कि RTI, matrimonial court या किसी दूसरे legal route में क्या difference है, तो delay करके situation को और complicated मत होने दीजिए। पहले exact notice और documents देखकर सही route समझना जरूरी है।
Case-specific caution: यह Delhi High Court decision एक particular RTI dispute पर था। इसका मतलब यह नहीं कि financial information किसी भी matrimonial proceeding में कभी disclose नहीं करनी पड़ेगी। Court proceedings में applicable disclosure rules अलग हो सकते हैं और facts के अनुसार financial information मांगी जा सकती है।
